A Health and Safety Representative Is Not Your Supervisor: Who Can Help in NSW
By SkillHaus ·

Your supervisor allocates the work. A health and safety representative—an HSR—has a different role: representing an elected work group on health and safety. Knowing the difference helps a worker find the right conversation when a concern affects the crew.
This article covers NSW. Victorian HSR rules and terminology need their own check; do not assume every power or procedure transfers unchanged across the border.
Representation, not line management
SafeWork NSW says HSRs are elected to represent their work group. Their functions include investigating work-group safety complaints, monitoring relevant compliance measures and inquiring into risks. They do not replace the business’s responsibility to manage safety. Read the regulator’s HSR-role guidance.
Ask which work group you belong to and whether an HSR represents it. A person described informally as the “safety person” might instead be a manager, consultant or first aider. Those roles can be useful, but they are not automatically the same as an elected HSR.
Bring a work issue, not a complete legal case
You can describe the task, the concern and the response so far. Explain whether other workers appear affected and what you personally observed. An HSR can help raise a work-group safety issue; you do not need to arrive with a written legal argument or a diagnosis.
Keep personal information proportionate. A concern about access to a safe route may not require sharing a colleague’s medical details. SafeWork’s guidance recognises limits on HSR access to identifiable personal or medical information without consent.
Some powers depend on training and conditions
In NSW, issuing a provisional improvement notice or directing unsafe work to cease requires the relevant HSR training and the statutory conditions to be met. It is not an unrestricted power to stop any task for any reason. For a provisional improvement notice, an HSR must reasonably believe a person is contravening a WHS provision, or has contravened one in circumstances making continuation or repetition likely, and first consult the person. A direction to cease work has a different test: a reasonable concern that a serious risk arises from immediate or imminent exposure to a hazard, with the required consultation unless the urgency makes prior consultation unreasonable.
For workers, the practical point is to raise the actual risk promptly rather than trying to decide whether someone can issue a notice. Immediate danger needs an immediate safety response; do not wait for the next scheduled meeting to alert the workplace.
A useful conversation example
Hypothetical situation: several workers cannot follow conflicting instructions about entering a loading area. They tell the supervisor, then ask their HSR to help raise the unresolved work-group concern. They describe where the conflicting instructions occur and ask for one clear, safe arrangement. The HSR’s involvement is representation, not taking over the supervisor’s job.
After the discussion, ask who will communicate the response and whether the affected shifts will receive it. A change understood by one person is not necessarily a change understood by the whole work group.
If you work through a labour hire agency
SafeWork’s worker-obligations page says labour hire workers can raise WHS concerns with a supervisor, HSR or their agency. Identify the appropriate contacts before you need them. If the host and provider give different answers, describe that conflict instead of choosing whichever sounds easiest.
Keep a factual note of the concern, when it was raised and the next step. It can help avoid repeated explanations and make it clear when a matter remains unresolved. It is not a reason to circulate private allegations through a general crew chat.
Questions for a new starter
- Who is my supervisor for the task?
- Which work group covers me, and is there an elected HSR?
- How do I contact them privately if needed?
- What is the immediate route for an urgent hazard?
- Who at my employing agency handles an unresolved host-site concern?
This article explains an ongoing NSW representation framework checked on 29 October 2026. It does not announce new HSR powers this month. For a related current development, see our October psychosocial inspection update, where clear reporting routes are equally important.
